I say good for the student for knowing how to use his weapon. It sounds from that article like this was a clear self-defense/home-defense case.

Person goes home late at night, noticed garage open, gets weapon to protect self while investigating, gets accosted, and may be put in jail for using weapon to protect self.

Sounds stupidly typical. Not quite up there with homeowners being sued if the burgler gets cut on glass in the window that was broken to get into the house.

Since it was a sword (instead of a baseball bat) will be bad for the poor guy.
